Can plastic surgeons use federal IDR?

Yes, for insured work. Out-of-network emergency care, including ED call for facial trauma and hand injuries, always qualifies for federal IDR. Reconstructive surgery at in-network facilities qualifies unless a compliant notice-and-consent waiver was signed. Cosmetic self-pay cases, Medicare, Medicaid, and office procedures are outside the process.

The boundary is payment, not procedure

The cosmetic question has a cleaner answer than most surgeons expect. The No Surprises Act arbitrates out-of-network claims under commercial insurance. A purely cosmetic case never enters the process because no insurer is billed; the patient is protected by good faith estimate rules instead. The moment the same surgeon operates on an insured indication, a breast reconstruction, a septal repair with documented obstruction, a scar contracture release, the claim is a commercial insurance claim, and the Act's protections and arbitration pathway attach normally.

Emergency call is the cleanest claim

Emergency services can never be waived. The plastic surgeon called in for a midface fracture, a flexor tendon laceration, or a complex facial wound holds a protected claim whenever the patient's plan is commercial and the surgeon is out-of-network. Protection starts in the emergency department and runs through post-stabilization care, covering the staged repairs that follow the initial encounter while the patient cannot reasonably travel to a network provider.

Scheduled reconstruction and consent

Scheduled reconstructive surgery at an in-network facility carries the notice-and-consent caveat. A facility can present a waiver at least 72 hours ahead with a good faith estimate; validly signed, with a genuine in-network alternative available, it moves the operating surgeon's claim outside the process. The conditions fail more often than they hold. Reconstruction is frequently staged, specialist-specific, and scheduled inside the 72 hour window after cancer surgery, and a waiver is void when no in-network plastic surgeon could actually do the case.

The exclusions

Government programs sit outside the federal process: Medicare, Medicare Advantage, Medicaid, TRICARE, and workers compensation all route elsewhere. Office procedures do not qualify, since offices are not facilities under the statute. Self-funded employer plans arbitrate federally; fully insured plans in states with their own arbitration systems may route there instead. The eligible core for a plastic surgery group is the ED call book plus insured reconstruction at hospitals and surgery centers.

Sort your book by the boundary

Lido IDR maps each claim to the right side of the boundary, verifies every consent assertion against the executed form, and files the qualifying claims for a flat fee per arbitration. Talk to an IDR specialist.
